Your rights if your Landlord does something wrong

For some actions or a failure to act, you can apply for an Order telling your landlord that he must return the rent you have paid for up to two years.


How to get your rent back if the landlord has done something wrong
The following are situations when you can apply for a Rent Repayment Order:
- The home you live in should be licensed by Brent Council, but your landlord has not applied for a licence, or he has applied and been refused or he had a licence which has been revoked
- Brent Council issues a Notice which says your landlord must do works to your home, but they do not do the works
- Brent Council tells your landlord that your home may only be used in a certain way and your landlord does not comply with this instruction
- Your landlord has broken the regulations of a Redress Scheme (when this is set up in late 2026)
- Your landlord has harassed you or done things that put you under pressure to leave your home
- Your landlord evicts you without going through the correct legal process
- Your landlord forces entry to your home through threats or violence
- Your landlord is not allowed to let your home because he has been given a Banning Order
- Your landlord breaks the rules about letting or marketing the property
- Your landlord fails to register with the Private Rented Sector Database when it comes in later in 2026.
Important Note:
If all or part of your rent is paid through housing benefit/Universal Credit, Brent Council can apply for this part of the rent to be repaid to them.
